As a result, the obligations were not fully fulfilled, and the remainder of the prepayment has not been returned to us for more than six months! At the moment, there is no constructive dialogue on the refund. It is necessary to involve lawyers to prepare a statement to the court. Your answer is a blatant attempt to mislead future tenants. Your statement that the repairs were carried out by the lessor's forces is not true: we restored the equipment with our own forces and resources right on the site (we brewed a bucket) so as not to completely disrupt the schedule. We carry out work at socially significant facilities where deadlines are strictly regulated, as timely heat supply to civilian facilities depends on it. We did not "change our mind" and did not cancel the contract for no reason — we were forced to promptly involve another, reliable landlord, since your equipment with a hastily repaired bucket did not allow us to guarantee the completion of work on time. Also, the act of completed work for "all hours", including your risks, was signed and paid. But the appropriation of other people's money without supporting documents is not "inherent risks", but unjustified enrichment. Withholding an advance payment for more than six months in the absence of a counter-performance of work looks like a scheme. At the moment, we have already sent an application to the court for a court order to forcibly recover our money, and the court's decision may become a contender if unproven and unworked hours are recognized as a "risk" by the landlord. By the way, you yourself acknowledged this fact in your pre-trial correspondence: "as soon as the act of completed work is signed and returned, we will refund the excess prepaid amount."
