We rented a crawler excavator with a crew, made an advance payment for 50 operating hours. As a result: The excavator broke down almost immediately. In order not to disrupt the work completely, we (the Tenant) were forced to repair it on our own at the facility. Due to a malfunction of the equipment, the work crew and trucks were inactive for 8 hours. We have suffered losses. As a result, the obligations were not fully fulfilled, and the remainder of the prepayment has not been returned to us for more than six months! At the moment, there is no constructive dialogue on the refund. It is necessary to involve lawyers to prepare a statement to the court.
