I'm writing from my husband's account. I used the store, and everything was fine. But the other day, I accidentally broke a bottle of lotion that had "tester" written on it. The store employee demanded to pay the cost of the tester. Explaining this by saying that the tester is new and came recently. 1. The RA Law "On Consumer Rights Protection" (2001) Article 16: the consumer is obliged to pay only for the goods purchased under the contract of sale. The tester is not a product for sale, but a demo sample. Article 6: The seller is obliged to provide reliable information about the goods. If the bottle says "tester", it means that it cannot be sold as a regular product. 2. The Civil Code of the Republic of Armenia (art. 1058) Damage is compensated only if it is caused by the culpable actions of a person. The accidental fall of the tester during normal use is not the buyer's fault. Thus: The tester is a demo sample, not a product for sale. The Law of the Republic of Armenia on Consumer Rights Protection (art. 16) and the Civil Code of the Republic of Armenia (art. 1058) release me from the obligation to compensate damages in such a situation. Both the store's managers and employees are probably aware of this, but hoping that customers don't know about it, they fraudulently demand payment. I paid for the tester because I'm not a conflicted person, and I wasn't sure if I was right. But after understanding the situation, I realized that I had been deceived. This is unpleasant, as I often purchased goods from this branch. Dear future buyers, keep this in mind.
