Date and time of the visit: September 30, 20:15. The bottom line: they refused to purchase a subscription for the "-30% off all subscriptions from September 25 to September 30 (inclusive)" promotion. I am a regular customer of T-tau Gym (I have been going for 6 months now). I saw a post on the club's official Instagram account (ttau-gym) with a 30% discount on all subscriptions up to and including September 30 (there is a screenshot). I came to the hall at 3 Almaty Street (Astana) at 20:15 on the 30th to buy a subscription for the promotion. They refused on the spot, referring to the fact that I already have a valid subscription, and that there was supposedly some kind of limit. There were no restrictions on existing clients in the publication. Why do I consider the refusal illegal: 1. In accordance with paragraph 1 of Article 6 of the Law of the Republic of Kazakhstan "On Advertising", advertising must be reliable and recognizable at the time of its presentation.; 2. Article 7 of the same law prohibits inappropriate (including misleading) advertising; 3. In accordance with Article 10 of the Law of the Republic of Kazakhstan "On Consumer Rights Protection", consumers have the right to complete, reliable and timely information about the service and its price.; 4. If the price/ conditions were duplicated at the point of sale, then according to art. 447 of the Civil Code of the Republic of Kazakhstan this is a public offer, and refusal to sell on the announced terms in the absence of pre—specified restrictions is incorrect. What am I asking for: - To understand the current situation by protecting my rights as a consumer; - Officially clarify where and when the club announced restrictions "only for new customers / without a valid subscription" (there were none in the post), and in the future indicate all restrictions in advertising. A great gym, I like it, a large number of exercise machines, a dumbbell for every taste and size, two floors with a cardio zone on the second, wonderful showers and changing rooms, but one thing is annoying that the windows are open when the cold wind is outside. Just watch the moment, the coach opens a window to one side of the hall and he goes to the other side and runs on the treadmill there, for whom he opened it, for himself, so run near this open window, for me it is not necessary.
